Terms of Service
Last Updated: May 17, 2026
These Terms of Service (“Terms”) govern all services provided by Better Brand Designs, a sole proprietorship (“Better Brand Designs,” “Company,” “we,” “our,” or “us”), to the client, customer, business, or person purchasing or using our services (“Client,” “you,” or “your”).
By submitting payment, approving a proposal, signing an invoice, completing an onboarding form, checking an acceptance box, purchasing a service, or continuing to use our services, you agree to these Terms.
These Terms are written in plain English so expectations are clear. They are intended to protect both you and Better Brand Designs by explaining what is included, what is not included, how billing works, what happens if services are cancelled, and what risks come with websites, hosting, SEO, advertising, AI tools, and third-party platforms.

3. Complete Disclosure: No Guaranteed Outcome
Websites, SEO, ads, hosting, AI tools, tracking systems, third-party platforms, and digital marketing all involve risk. Better Brand Designs will use reasonable skill, strategy, tools, and effort to provide services, but we do not guarantee specific business outcomes.
We do not guarantee:

That AI-generated content or images will be error-free or exclusive
Digital results can be affected by many factors outside our control, including competition, market conditions, Google algorithm changes, ad platform policies, client budget, reviews, website age, backlinks, client responsiveness, customer demand, third-party outages, hosting issues, DNS issues, plugin conflicts, and platform changes.
4. Pricing, Plans, and Billing
Pricing may change from time to time. Because our plans, packages, and offers may be updated, the current pricing and deliverables will be the pricing and deliverables shown on your proposal, invoice, checkout page, written agreement, or plan description at the time of purchase.
4.1 Website Builds and One-Time Services
Website builds and one-time services must be paid upfront unless we approve a payment plan or installment option in writing.
Some website builds may be eligible for a 12-month installment option. If you choose an installment option, you remain responsible for all payments required under that installment agreement.
4.2 Self-Checkout and Budget Website Offers
For self-checkout, starter, discounted, or budget website offers, payment is required upfront through Stripe or another approved payment method before work begins.
The project timeline does not begin until payment has been received and all required onboarding materials have been submitted.
4.3 Monthly Subscriptions
Monthly plans, hosting plans, care plans, SEO plans, website maintenance, Google Ads management, AI content services, and other recurring services are billed automatically using Stripe or another payment method on file.
Unless otherwise stated in writing, monthly services are month-to-month and may be cancelled as described in these Terms.
4.4 Enterprise Plans
Enterprise plans require a minimum 12-month commitment unless otherwise stated in writing.
4.5 Annual Plans
We may offer annual billing for monthly services. Annual plans may receive a discount, currently 17% when offered. Annual payments are non-refundable once processed unless otherwise required by law or stated in writing.
4.6 Upgrading from Starter to Custom Design
If a client is on a Starter Plan and later upgrades to a Custom Design plan, Better Brand Designs may apply a $100 credit for each month the client has been on the Starter Plan, up to a maximum credit of $300.
This credit only applies when the client purchases the Custom Design website in full. If the client chooses the monthly or installment option for the upgraded website, the credit does not apply and the regular amount is due.
5. Late Payments, Failed Payments, and Suspension
If a payment fails, is declined, is reversed, or becomes past due, you will have a 15-day grace period to resolve the issue unless we state otherwise in writing.
We may attempt to process the payment up to three times. After three failed payment attempts or after the grace period expires, we may suspend services until the account is brought current.
Suspension may include pausing website updates, hosting, support, maintenance, SEO services, Google Ads management, reporting, email support, or access to other services.
We are not responsible for downtime, missed leads, lost revenue, lost rankings, missed opportunities, business interruption, email issues, or advertising disruption caused by late, failed, disputed, reversed, or unpaid invoices.
All unpaid balances remain due.
6. Refund Policy
All fees are non-refundable once work has begun.
This includes, but is not limited to:
Website builds
Setup fees
Design work
Development work
SEO work
Google Ads management
Hosting
Care plans
Monthly subscriptions
Content writing
AI-assisted content
Blog writing
Consulting
Strategy work
Third-party setup
Custom requests
Subscription payments already processed are non-refundable. You may cancel future billing according to the cancellation terms below.
Better Brand Designs does not offer a satisfaction guarantee unless one is specifically stated in writing for a specific offer.
7. Chargebacks and Payment Disputes
If you initiate a chargeback, payment dispute, reversal, or similar claim for a valid charge, Better Brand Designs may immediately suspend services while the issue is investigated.
If a payment is reversed or remains unpaid, you may not use, publish, transfer, copy, or benefit from any unpaid work product, including website designs, website files, content, layouts, graphics, code, strategy, or deliverables created by Better Brand Designs.
You agree to reimburse Better Brand Designs for reasonable costs related to invalid or improper disputes, including chargeback fees, collection costs, administrative costs, attorney fees, and any other costs allowed by law.
8. Project Timelines
Project timelines are estimates and are based on business days, not calendar days.
Unless otherwise stated in writing:
Website mockups are typically delivered within 2 business days.
Website builds typically take 10 to 40 business days depending on the selected plan, scope, client responsiveness, and complexity.
Project timelines begin only after all of the following have been completed:
Payment has been received.
The required onboarding form has been completed.
Required assets, content, logins, access, and approvals have been provided.
Delays in client responses, missing content, missing approvals, missing access, scope changes, third-party issues, or additional requests may delay the project.
9. Design Concepts, Revisions, and Scope Changes
Unless otherwise stated in writing, website design packages include two initial design concepts and up to five rounds of revisions.
A revision is a reasonable adjustment to work already included in the approved project scope. Examples include:
Changing text on an existing page
Swapping images
Adjusting colors or fonts within the brand direction
Modifying spacing or layout within the same design concept
Reordering sections
Making reasonable edits to existing content
Adjusting calls to action
A new request, scope change, or billable change may include:
Adding new pages not included in the original scope
Creating new service pages, city pages, landing pages, or blog posts
Rebuilding an approved design from scratch
Changing the overall design direction after approval
Adding new functionality
Adding booking systems, calculators, dashboards, portals, e-commerce, memberships, or custom integrations
Rewriting large amounts of copy after approval
Changing project requirements based on missing, inaccurate, or late information
Redesigning sections that were previously approved
Troubleshooting or repairing issues caused by client edits, third-party vendors, or outside hosting
Additional work may require additional payment before it is started.
10. Client Approval, Pauses, and Project Abandonment
Clients are responsible for reviewing designs, pages, content, and deliverables in a timely manner.
Unless otherwise stated in writing, clients should provide feedback or approval within 7 business days of receiving a design, mockup, revision, page, or deliverable.
If we do not receive feedback, approval, content, or required access within 7 business days, the project may be paused.
If a project is paused because of client delay, the timeline may be rescheduled based on our current workload.
If a client becomes unresponsive for 30 calendar days or more, the project may be considered abandoned. If a project is abandoned:
Payments already made are non-refundable.
Any unpaid balance for completed work becomes due.
The project may be closed.
Restarting the project may require a restart fee, updated pricing, or a new agreement.

14. SEO and Google Business Profile Services

You authorize Better Brand Designs to edit your website, Google Business Profile, metadata, service pages, photos, posts, products, services, descriptions, tracking tools, and related SEO assets when those services are included in your plan.
SEO results take time and can be affected by competition, Google algorithm changes, reviews, proximity, website age, client budget, backlinks, business category, market conditions, third-party platforms, and other factors outside our control.
Reports are informational and are used to guide our internal work. Reports do not automatically create additional work obligations unless the work is included in your plan or separately approved.
15. Google Ads Management
Better Brand Designs may provide Google Ads management services when included in your plan or purchased separately.
Unless otherwise stated in writing:
The client owns the Google Ads account.
Ad spend is paid directly by the client to Google.
Better Brand Designs charges a management fee of $499 per month or 15% of ad spend, whichever is greater.
If Better Brand Designs creates the ad account, the account may be transferred to the client after all balances are paid.
Google Ads services may include campaign structure, ad copy, landing page recommendations, landing pages when included, conversion tracking, call tracking setup, extensions, keyword research, performance review, and ongoing adjustments.
We do not guarantee clicks, leads, conversions, cost per lead, sales, revenue, account approval, ad approval, or specific performance outcomes.
Google may reject, limit, suspend, disapprove, change, or remove ads, campaigns, keywords, accounts, tracking, or features at any time. Better Brand Designs is not responsible for Google policy changes, disapprovals, account suspensions, billing issues, platform outages, or changes in ad costs.
16. Hosting, Maintenance, and Security
Better Brand Designs may host websites through third-party hosting providers, including SiteGround or other providers.
Most managed client websites may be hosted under Better Brand Designs’ hosting account. Clients may choose outside hosting, but Better Brand Designs does not manage websites hosted elsewhere unless we specifically agree in writing.
We may move hosting providers, servers, plans, tools, or configurations when needed for performance, security, cost, reliability, support, or technical reasons.

Website hosting
WordPress updates
Plugin updates
Theme updates
Security tools
Backups
Basic uptime monitoring
Malware scanning

Hosting uptime depends on third-party hosting providers, DNS, plugins, internet infrastructure, software, security threats, platform issues, and other factors outside our control. We do not guarantee uninterrupted uptime beyond what the hosting provider offers.
16.1 Hacked Sites and Malware
If a website hosted or maintained by Better Brand Designs is hacked or affected by malware, we will make a reasonable best-effort attempt to recover, clean, restore, or repair the website.
Malware cleanup and emergency repair are included on managed plans unless the issue was caused by client actions, outside vendors, unauthorized access, unsafe passwords, third-party hosting, unsupported plugins, or changes made outside our control.
We do not guarantee that every hacked website can be fully restored, that all data can be recovered, or that future attacks can be prevented.
16.2 Client Access
For security and quality control, clients do not receive WordPress admin access, hosting access, cPanel access, SiteGround access, DNS access, or domain registrar access unless Better Brand Designs specifically agrees in writing.
If a client, employee, outside vendor, or third party edits the website, hosting, DNS, domain, plugins, code, or settings and causes an issue, repair work may be billed separately.
17. Domains, DNS, and Email
Better Brand Designs may register or manage domains for clients.
If a domain is registered in our account for the client, the client owns the domain, and Better Brand Designs manages renewal while the client remains active and current on required payments.
If a domain is registered in the client’s account, the client is responsible for renewal, billing, login access, and account security.
Better Brand Designs may manage DNS records when needed for website hosting, email, tracking, verification, analytics, and related services.
Better Brand Designs may provide or help set up business email. When offered, one Google Workspace email account may be included. Additional email accounts are billed at market rate unless otherwise stated.
We are not responsible for third-party email outages, spam filtering, email deliverability issues, mailbox limits, lost emails, platform changes, account suspensions, DNS propagation delays, or issues caused by Google Workspace, Microsoft 365, SiteGround, domain registrars, email providers, spam filters, or other third parties.

Better Brand Designs may replace plugins, tools, platforms, integrations, software, or services when we believe it is necessary or helpful for security, performance, reliability, cost, compatibility, or service quality.

Better Brand Designs may provide template-based Privacy Policies, Terms of Service, cookie notices, accessibility statements, or other legal-style website pages when included in a project.
These materials are templates only and are not legal advice.
Clients are responsible for having an attorney review any legal pages, privacy policies, cookie notices, disclaimers, accessibility statements, terms, or compliance-related content before publishing or relying on them.
Clients are responsible for disclosing the use of cookies, analytics, tracking pixels, call tracking, forms, email tools, CRMs, advertising tools, and lead capture tools in their own Privacy Policy or legal notices.
Better Brand Designs may follow reasonable accessibility practices, but we do not guarantee full ADA, WCAG, or other accessibility compliance unless a specific accessibility compliance service is purchased in writing.
Better Brand Designs does not build websites for regulated industries unless we specifically agree in writing. Clients are responsible for all industry-specific compliance requirements.
20. Tracking, Analytics, Forms, and Data
Better Brand Designs may install or configure tools such as Google Analytics, Google Search Console, Google Tag Manager, Meta Pixel, call tracking, contact forms, quote request forms, CRM tools, and related tracking systems.
By using our services, you consent to the installation and use of these tools when they are part of your project or plan.

We are not responsible for lost form submissions, spam submissions, failed email delivery, CRM errors, tracking inaccuracies, analytics discrepancies, call tracking errors, third-party outages, or data loss caused by third-party systems, hosting, plugins, email providers, spam filters, client settings, or platform issues.
21. Website Ownership and Intellectual Property
21.1 Client Ownership
For Custom Design websites, the client owns the final website files after the website has been paid in full.
Client ownership does not begin until all required payments, balances, fees, installment payments, transfer fees, and outstanding invoices have been paid.
Client ownership may include the final WordPress site files, final website content, and final visual website design as published or delivered.
21.2 Starter Plans
Starter Plan websites are subscription-based unless otherwise stated in writing. If a client cancels a Starter Plan, the client does not own or keep the website unless a separate buyout, upgrade, or transfer agreement is approved in writing.

21.4 Portfolio Rights
Better Brand Designs may display completed work in our portfolio and marketing. This may include screenshots, the client’s business name, logo, website images, general project description, and publicly visible results unless the client requests otherwise in writing.
22. Website Transfers and Cancellation of Hosting
If a client has a paid-in-full Custom Design website and cancels monthly service, the client may request a website transfer.
A $150 website transfer/export fee applies unless otherwise stated in writing.
All outstanding balances must be paid before any transfer, export, backup, files, domain, or access is released.
If hosting is cancelled, the client has 30 days to request a transfer or export. After 30 days, website files, backups, staging copies, and related data may be deleted.
Backups may be deleted after 30 days following cancellation.
If the client moves the website away from Better Brand Designs, the client is responsible for purchasing and maintaining their own hosting, plugin licenses, premium tools, email services, security tools, backups, updates, DNS, and support.
Better Brand Designs is not responsible for websites after they are transferred away, moved to outside hosting, modified by another provider, or disconnected from our systems.
23. Monthly Subscription Cancellation
Monthly subscriptions may be cancelled at any time unless the client is under a written minimum-term agreement, such as an Enterprise plan.
Cancellation must be requested in writing by email, online form, or another approved written method.
Cancellations must be requested before the next billing date to stop future billing. No prorated refunds or partial refunds are provided.
Cancelling a monthly service may result in the loss of hosting, plugin licenses, premium tools, support, maintenance, backups, reporting, SEO work, Google Ads management, email services, or other services included in the plan.
